Our store is hosted on Shopify Inc., which provides the e-commerce platform that allows us to sell our Products and Services.

AutoLinkr Products are consumer electronic accessories. They do not control, modify, or affect vehicle operation, including steering, braking, acceleration, airbags, or other safety-critical systems.

Certain Products may be capable of displaying visual or video content. Such capability does not mean that viewing video content is safe, legal, or appropriate in all circumstances.

Video playback is not intended for driver viewing while a vehicle is in motion. Viewing video content while driving may create a distraction and increase the risk of accident, injury, or death. Drivers are solely responsible for operating vehicles safely and in compliance with all applicable laws.

AutoLinkr does not authorize, encourage, promote, or condone use of any Product in a manner that violates the law or compromises safe vehicle operation. Any such use constitutes misuse of the Product.

AutoLinkr does not control how Products are used after sale, and you are solely responsible for safe and lawful use.

SECTION 14 – DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY
All Products and Services are provided “as is” and “as available,” without warranties of any kind, express or implied.

To the maximum extent permitted by law, AutoLinkr and Badger Ecom LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including personal injury or death, arising from misuse of Products, failure to follow safety guidance, violation of applicable laws, or unsafe vehicle operation.

Some jurisdictions do not allow certain limitations; in such cases, liability is limited to the maximum extent permitted by law.

SECTION 15 – INDEMNIFICATION
You agree to defend, indemnify, and hold harmless AutoLinkr, Badger Ecom LLC, and their owners, officers, directors, employees, agents, suppliers, and affiliates from any and all claims, demands, damages, losses, liabilities, costs, and expenses, including attorneys’ fees, arising out of or related to your use or misuse of any Product, vehicle-related use, viewing video while operating a vehicle, violation of applicable laws, or any allegation that AutoLinkr is responsible for damages caused by your conduct.

AutoLinkr shall not be responsible for paying the legal fees, costs, or damages of any claimant or third party arising from such conduct. This obligation survives termination of these Terms.

SECTION 16 – DISPUTE RESOLUTION; BINDING ARBITRATION
Any dispute, claim, or controversy arising out of or relating to these Terms, the Products, or Services shall be resolved exclusively through final and binding arbitration on an individual basis, rather than in court, except for claims seeking injunctive relief for intellectual property misuse.

Arbitration shall be administered by the American Arbitration Association under its Commercial Arbitration Rules. The arbitrator shall have exclusive authority to resolve disputes relating to the interpretation or enforceability of this provision.

SECTION 17 – CLASS ACTION WAIVER
You agree that disputes shall be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class or collective proceeding. If this waiver is found unenforceable, the arbitration provision shall be null and void.

SECTION 18 – LIMITATION ON TIME TO BRING CLAIMS
Any claim or cause of action arising out of or related to the Products, Services, or these Terms must be commenced within one year after the claim arises, or it is permanently barred, to the fullest extent permitted by law.

AutoLinkr shall not be liable for any failure or delay in performance due to causes beyond its reasonable control, including natural disasters, pandemics, labor disputes, supply-chain disruptions, shipping delays, governmental actions, or carrier failures.

SECTION 20 – GOVERNING LAW
These Terms are governed by and construed in accordance with the laws of the United States, without regard to conflict-of-law principles.

SECTION 21 – ENTIRE AGREEMENT; SEVERABILITY
These Terms constitute the entire agreement between you and AutoLinkr. If any provision is found unenforceable, the remaining provisions shall remain in full force and effect.

SECTION 22 – CHANGES TO TERMS
We may update these Terms at any time. Continued use of the Products or Services constitutes acceptance of the updated Terms.
